In both cases last move was not 0-0, because of the promotion on d8, so Black has no last move, so he has the move and mates with 1... ?

I checked Andrew's source and the intention is the following

The only feasible last move is 0-0, which is illegal, so Black must replace K and T and make a legal move with Ke8
